Gujarat HC: Relaxation in Age, Forget General category

This important judgement was delivered on 11 September 2015 on the interpretation of granting benefits of the quota system in government jobs in the state. The Gujarat HC stated that all the meritorious reserve category students who have availed age relaxation in the upper age limit, cannot be put in general category list even if they have scored more than cut off marks for general category.

No benefit of shifting to general category, if quota candidates obtain age relaxation.

WHY GUJARAT HC PASSED ON THIS JUDGEMENT?

Gujarat Public Service Commission was to recruit 948 posts for Class III in various government departments in 2011.  A division bench headed by Justice M R Shah quashed the single judge’s order that stated MRCs should be put in general category merit list in 2013. Then, the finalised list prepared had not listed the meritorious reserved category students in the general category list who had availed age relaxation.

Certain candidates from reserved category raised the objection because they were kept in waiting list after MRC’s were not given benefit to shifting to general category. The Single bench judgement asked GPSC in 2013 to add these 33 SC students to general category.

The state and GPS challenged this decision including that once reserve category candidate obtains the benefits of age relaxation, he/she cannot take benefit of shifting to general Category even if he/she is MRC. Adding such MRCs in the general list will be against natural justice and thus, earlier orders must be squashed, Authorities added.

 

WHO ARE THESE MERITORIOUS RESERVE CANDIDATES?

If an SC or ST candidate manages to get the first rank or qualify for the merit list, then they will be allotted seat under General Merit Quota. Hence some more seats will be available for SC/ST students in their respective categories.click here to read people review this concept.

Reservation policy should be fair. It should be taken care that no injustice is done to general category candidates.
